How long does a Michigan divorce take? The fastest you can complete an uncontested divorce in Michigan is 60 days (if you have minor children, the fastest you can complete a divorce is six-months).  The DivorceWriter documents and instructions allow you to complete your divorce as quickly as is legally possible.
Are court filing fees included with my purchase? No.  Each county in Michigan charges a filing fee when you file your divorce, and usually a separate judgment fee when the divorce is completed.  The filing fee may vary from county to county, but is usually $150 and the Judgment fee is usally $80.  If you cannot afford the filing fee, you may be eligible to have the fees waived (your county court clerk can provide details).
Do both of us have to go to Court? No. The spouse who files the divorce (Plaintiff) must attend a hearing in order to finalize the divorce. The non-filing spouse (Defendant) does not need to attend this hearing, since he or she will have filed an Answer and Waiver with the court. DivorceWriter Filing Instructions include sample testimony for the hearing.
How long can we take to complete the online questionnaire? You can take as long as you need to complete the questionnaire.  With your divorce purchase you are given a password protected account allowing you to access your questionnaire any time.  When you have completed the questionnaire to your satisfaction, you just have to press the "Submit for Printing" button.
Can I make changes after receiving the printed documents? Yes. If you entered something incorrectly, or your circumstances have changed requiring updates to your documents, you can make the changes from your account and we will reprint your documents at no additional charge (We provide one free reprinting, but you can have your updated documents e-mailed to you as many times as you need at no charge).

What is the process for filing our Michigan Divorce?

Note: The general instructions presented here are for informational purposes only. You will receive detailed and easy-to-follow guidelines for filing your Michigan divorce with your purchase.

STEP 1: Filing Your Petition

Review and sign the documents.

  • Bring the Filing Fee AND three signed copies of your Complaint for Divorce to the Clerk's office.
  • The Clerk will keep one copy of your Complaint and will “file stamp” your other two copies showing the date and time you filed your petition.
  • Schedule your hearing with the clerk.

STEP 2: The Waiver

You are filing an uncontested divorce, where both you and your spouse agree to the terms of the divorce. In a contested case, your spouse (the Respondent) would typically be served a copy of the petition. In your uncontested case, you do not need to pay extra to have your spouse served the papers. Instead, we have provided an Answer and Waiver for your spouse to sign.

  • Give your spouse a “file stamped” copy of the Complaint and the Waiver of Citation.
  • Your spouse signs the Waiver.
  • File the signed Waiver with the Clerk's office.

…Wait 60 days (or six-months if minor children involved from date Petition filed)

STEP 3 : Finalizing Your Divorce

Only the person, who filed the petition, has to go to the court hearing.

  • At the hearing, provide the court clerk with your signed copy of your Marital Settlement Agreement, Judgment, AND any supporting documents provided in your package.
  • Wait for the judge to call your case.
  • After the judge hears your testimony he/she will sign your Judgment of Divorce.

Once your Judgment is signed, your divorce is final.
