How long does a Illinois divorce take?

The DivorceWriter documents and instructions allow you to complete your divorce as quickly as possible. When you file an uncontested Petition for Dissolution (divorce), you schedule a hearing with the court clerk where your divorce will be finalized. This hearing, where your divorce is finalized, is usually scheduled one to two months from the date the Petition is filed.

If you qualify for a Simplified Divorce, you may be able to schedule your hearing on the same day you file (or within a week).

In Illinois you need to live separately from your spouse for six months before the divorce can be finalized.

Are court filing fees included with my purchase? No.  Each county in Illinois charges a filing fee when you file your divorce.  The filing fees vary, but typically are in the $250-$300 range.  If you cannot afford the filing fee, you may be eligible to have the fee waived (your court clerk can provide details).
Do both of us have to go to Court? No.  Although both of you will be signing the documents, only one of you has to be present at the court hearing.
What is an Illinois "Simplified" Divorce? A Simplified Divorce (or Dissolution) is a fast and easy way to complete an Illinois divorce, but there are several requirements. For instance, you must have no children, be married 8 years or less, and make less than a combined $35,000 annually. You can use the DivorceWriter interview to determine whether you qualify for a Simplified divorce.
Do you provide Cook County versions of your documents? Yes.  If you select Cook County as your filing County, we send you the official Cook County forms. If you select another county, we send Illinois specifc forms that work throughout the rest of the state.
How long can we take to complete the online interview? You can take as long as you need to complete the online interview.  With your divorce purchase you are given a password protected account allowing you to access it at any time.  When you have completed the online interview to your 100%, select the "Submit for Printing" button.
Can I make changes after receiving the printed documents? Yes. If you entered something incorrectly, or your circumstances have changed requiring updates to your documents, you can make the changes from your account and we will reprint your documents at no additional charge.

What is the process for filing our Illinois Divorce?

STEP 1: Review your Documents

Review and sign the documents. A notary may be required for some documents.

STEP 2: Filing the Petition

  • The petitioner goes to the Clerk of the Court's office (county specific contact information included with documents).
  • File the Petition for Dissolution of Marriage and any supporting documents.
  • Pay the County court filing fee.
  • Schedule your hearing date.

STEP 3 : Finalizing Your Divorce

Only the person, who filed the petition, has to go to the court hearing.

  • Bring your Judgment and copies of the documents you filed with the Petition to the hearing.
  • When your case is called be prepared to answer a few questions the judge may ask before he/she signs the Judgment (sample testimony guidelines are provided with documents)

Once your Judgment is signed, your divorce is final.
